The use of copyrighted work and the law
‘Fair use’ is the right to use, in some cases, materials which are protected by copyright law, without gaining explicit permission from the copyright holder or paying copyright fees. This is an important element of copyright law which prevents a complete prohibition of using protected creations. Fair use can be claimed when the benefit to public interest is considered greater than the harm which may be caused to the copyright holder. So, how can one use protected materials without risking theft charges in the USA and Israel? When do the interests of the public overrule the interests of the copyright holders? How does the new Israeli copyright change the picture?
